Article 1: Introduction and contact

1.1 Introduction

The present terms and conditions of sale apply exclusively to the company CLB (hereafter "CLB") and any person visiting the website or buying a product from the website www.linnealund.com (hereafter the "Client"). 

The terms and conditions of sale are available for anyone to read on the website www.linnealund.com (hereafter the "Website").

These terms and conditions of sale can be modified at any time. The terms and conditions applicable are those on the website at the date of the order

Article 2: Order

2.1 Terms and conditions for placing an order

The Client declares :

To aged of 18 or over and having the legal capacity to place an order on the website

To have a parental autorisation in case he is under the age of 18

To have authority for his personal assets

To accept without reserve these terms and conditions of sale

To be fully authorized to use a payment card to pay for his order

To have access to sufficient funds for the full payment of his order.

If one or more of these conditions are not met, the Client is not authorized to use this website and place an order.

2.2 Order

After placing an order, CLB will send the Client a confirmation email.

Article 3: Products

CLB presents on its website various Products for sale, along with their detailed descriptions.

CLB takes the utmost care to ensure that the colour, design and presentation of the Products, photos of which are displayed on the website, are faithful to the original Products.

However, given the method of presenting the Products on the website, it is possible that the appearance perceived by the Client of the photographic representation of the Products does not correspond to the product itself exactly. It should also be noted that the weights indicated on the Products may vary due to the artisanal character of the manufacturing process. CLB cannot be held responsible in the event of a manifest error between the product's characteristics and their representation.

Article 4: Price, availability, delivery, receipt and customs

4.1 Price

The prices shown on the website are in euros and include French taxes (European VAT and other applicable taxes) including:

- order processing fees

- all packaging, including casket

- not including postage which will be billed as an extra cost

- customization which will be billed additionally depending on the customer request

The Client is informed that delivery costs are charged on top of the price of the jewels and that these costs will be specifically indicated on the order summary and in the order confirmation email.

CLB reserves the right to change its prices at any time and without warning. Products already ordered will be invoiced at the prices when the order was placed.

4.2 Availability


The Products offered for sale by CLB are those that appear on the Site at the time of their consultation by the Client and within the limit of stock available. CLB reserves the right, at any time, to modify or cease to offer the Products offered on the Site; these changes will, however, have no affect on the orders accepted by CLB before these changes were applied.

4.3 Delivery

The Products will be delivered to the postal address provided by the Client at the time of their order.

Shipping will take place no later than three (3) business days following order confirmation, with the exception of a contrary provision which the Client will be informed of before placing his order, indicating an average shipping time.

Before a purchase can be dispatched CLB may need to confirm details with the Client’s card issuer. CLB will do its best to keep delays to a minimum.

Delivery time (in working days) starts from the moment an order is placed into the shipping partner’s hands. 

Any delivery delay will be communicated by the Client to CLB in writing as soon as possible with the latter raising a query with the carrier in question. The Client will have the right to cancel his order if delivery of the latter is more than seven (7) business days after the delivery date initially given and subject to a delay not due to the Client or to a case of force majeure.

In case the parcel is lost, CLB will process a refund in favour of the bank account debited when the order was placed, as soon as possible, to the exclusion of any other compensation, or will resend the Products at its own expense if the order has not been cancelled by the Client. In the event of partial delivery of the order, the delivery will be made in several installments and this right only concerns the balance of the order not delivered.

CLB will ship only to the following countries :

CLB works closely with its shipping partner to minimize the potential impact of custom delays on international Clients.

4.4 Receipt of products by the Client

Each delivery is deemed to be complete at the time of the Products being made available to the Client by the carrier, realized by the tracking system used by the carrier. No dispute relating to the delivery itself will be possible if the package appears as having been delivered, the carrier's IT system being admissible.

It is the Client's responsibility to check immediately, at the time of receipt of the Products, the conformity and integrity of the products delivered.

Without prejudice to the period the Client has to exercise their right to cancel as specified in article 7 below, it is up the Client to verify the shipments upon arrival and to communicate any reservations or claims to the carrier which appear to be justified in the event of delay, breakage or loss.

Any reservation of this type must also be notified to CLB Client Service Department, the coordinates for which appear on the Site, within the same period.

4.5 Taxes and duties

Taxes and duties are calculated according to your shipping destination. French VAT will be applied to orders dispatched within EU destinations. Most countries are shipped to on a DDP (Delivery Duty Paid) basis, which means that all relevant import taxes and duties will be included in the product price. 

4.6 Insurance

CLB insures each purchase during the time it is in transit until it is delivered to you. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfilment by CLB and transfer of responsibility in the same way.

Article 5: Payment

5.1 Accepted methods of payment

The payment of an order can be made by Visa/Mastercard and American Express.

The information for payment (address, amount, order, etc.) can be found in the order confirmation and must be respected to the letter to ensure the order is processed.

Payment by cheque or postal order is not accepted.

5.2 Payment refused and order cancellation

For security reasons, CLB reserves the right to refuse payments and also cancel orders:

- if a delivery address is not referenced, deliveries to hotels and PO boxes

- if the person who placed the order cannot be contacted

- if there is any doubts about the legitimacy of the order

5.3 Payment Security

All payments are done through the Stripe software that allows us to provide a maximum guarantee for the customer.

However, if for any reason the customer wishes to pay through a bank transfer, it is possible.

5.4. Website Security

To help ensure that your shopping experience is safe, simple and secure CLB uses Secure Socket Layer (SSL) technology. This encrypts and protects the data you send to us over the internet. If SSL is enabled then you will see a padlock at the top of your browser and you can click on this to find out information about the SSL digital certificate registration. 

You will also notice that when you look at the location (URL) field at the top of the browser you will see it begin with 'https:' instead of the normal 'http:'. This means that you are in secure mode.

Article 6: Liability

CLB decline all liability in the case where the item delivered does not respect the laws of the destination country outside of the European Union.

CLB will take every professional precaution to ensure customer service. Nevertheless, CLB cannot be deemed liable if they are unable to fullfil their contractual obligation due to unforeseeable circumstances or force majeure as defined by jurisprudence under French jurisdiction.

Under no circumstances could CLB be considered liable for the loss of profit, commercial loss, loss of data, loss of income or any other indirect loss or which was not foreseeable at the time of visiting the website or at the time of concluding the contract of sale between themselves and the Client.

CLB's responsibility will not be engaged due to any inconveniences or damages inherent to the use of the Internet network, notably a break in service, the occurrence of bugs, an external attack or the presence of computer viruses.


Article 7: Reserve of ownership

The goods delivered will remain property of CLB until the Client takes physical possession of the delivered product once it has been paid for.

Article 8: Right of withdrawal

CLB is primarily concerned with satisfaction of his Client. The Client has an unconditional right of withdrawal without explanation within fourteen (14) calendar days of delivery for the items ordered from the online store.

Please note that the delivered products must not have been used. If the Client would like to exercise his right of withdrawal and cancel the contract of sale, CLB will refund the amount spent less any postage for the ordered items which remains at his cost and under the condition that the products have not been worn or damaged and are returned in their original Linnea Lund packaging, otherwise the item will be sent back to the Client.

To exercise his right of withdrawal, the Client must inform CLB of his decision to withdraw within fourteen (14) days of receipt of his purchase, using the withdrawal form that he has duly completed, downloaded from the MY ACCOUNT page and return the form and items by any secure means and against signature to the following address:

Returned items must be in their original packaging.

Postage for returned items is at the Client's cost.

Following receipt of returned items, CLB will immediately refund the Client the entire order excluding postage costs. The refund will be by bank transfer to the card that was used to pay the initial invoice. Returned items can be replaced or exchanged. 

Article 9: Website access and property rights

CLB grants the Client access to and the use of our website for his own personal use. 

The reproduction or use of all or part of these elements is only authorized for information purposes for personal and private use; any reproduction or use of copies made for other purposes is expressly prohibited. Neither the Site, in full or in part, nor its contents can be used, reproduced, duplicated, copied, transferred, made accessible, modified or used in any other manner, in full or in part, for any purpose whatsoever without prior written authorization from CLB. Any other use constitutes a forgery.

Article 10: Personal data protection

CLB pledges to protect any and all personal data pertaining to its Clients. All personal data pertaining to the Client collected by us will be processed in the strictest confidentiality, in compliance with our policy for personal data protection:

- Client's personal data collected from elements that he enter into the website will exclusively be used to process his order in the best possible conditions and to recommend suitable offers

- Client's personal data are never rented out, sold or passed on to a third party, other than to process your order.

- The Client has the right to access, oppose, modify and delete all of his personal information by writing to info@linnealund.com (Loi "informatique & liberté" du 6 janvier 1978 modifiée en 2004)

- Non-personal data provided by the Client's activity on the website is used to improve customer services, in particular website usability, products presented and customer relations.


The processing of information provided by the intermediary of the website www.linnealund.com is the object of a CNIL declaration (xxx).

Our store is hosted on Squarespace Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Squarespace’s data storage, databases and the general squarespace application. They store your data on a secure server behind a firewall.

Article 11 : Non-compliant product(s)

11.1. Right of compliance and warranty

CLB guarantees respectively that the brand's Products comply with the use for which they are intended and do not present any faults or hidden defects making them dangerous or unsuitable for their normal use.

 

In the case of a Product not complying with the information given during presentation of the Products on the Site, and in accordance with article L.211-5 of the Consumer Code, or if these Products present hidden defects referred to in article 1641 of the Civil Code, the Client will receive a refund within thirty (30) days of the date on which the Product is received, subject to respect of the conditions mentioned below.


11.2. Right to return


In the event that a non-compliant Product is received, the Client is permitted to return the non-compliant Product to CLB within fourteen (14) days from the Product being received.

In this respect, it is specified that CLB does not accept packages sent postage due and that the Product must be returned in its original condition and packaging. The Client will attach the return to the package. CLB will inspect the Product for non-conformity and if this is confirmed the Client will receive a refund.

This refund will be made to the bank account debited when the order was placed for the Product within thirty (30) days of CLB receiving the non-compliant Product. This refund will also include the refund of the initial delivery costs if all the Products delivered are returned. If only part of the order is returned, the initial delivery costs will not be refunded.

All risks related to the Product's return shall remain the Client's responsibility.

 

Article 12. Repairs (Customer Service)

 

CLB offers a repair service. 

This service is only available if the repair is possible, meaning :

If the product is a genuine 0.88 product with the 0.88 logo / stamp.

If it is possible to recreate the original product.

If the spare parts required for the repair are available.

 

Please return the 0.88 product in its original packaging to the CLB head offices by post. The parcel must be sent recorded delivery and insured. CLB declines all liability in the case of damage, loss or theft during transportation.

 

 

Article 13: Applicable law and jurisdiction

 

The present terms and conditions of sale are subject to French law.

 

Any disputes concerning the commercial relationship between CLB and the Client are subject to French jurisdiction
